Understanding Our Unbiased Role as a Transaction Real Estate Agent

Florida law provides that we (Jeanne DeLaurentis, members of the DeLaurentis Group at Williams Island Realty, and Williams Island Realty LLC) are beholden to represent and facilitate the real estate transaction and not to the buyer or seller.

Under Florida's transactional representation rules, we are in a position of neutrality to oversee the process of selling or buying real estate because no fiduciary duty is owed to either the seller or the buyer. Because we do not take on a fiduciary role, we are free to focus on the transaction itself to ensure that it flows as smoothly and expediently as possible.

As the representative of the transaction, we take on a role of impartial facilitator and focuses on upholding very important tenets:

Timely Disclosure: We will disclose the exact nature of our relationship to you upon the first meeting. So whether you are a buyer or a seller, you will never be left to wonder about our motives or whom we really work for.

Offer Presentations: We will present all buyers' offers to sellers in a timely manner to expeditiously move the transactional process along in a manner that serves all parties well. By ensuring that an offer is presented expediently and factually, we serve you with uncompromising efficiency and integrity.

Informed, Timely Updates: We will advise the parties of any pertinent information relevant to the transaction status. Our impartial role as facilitator ensures that all information will be presented in a timely, forthright and truthful manner.

Professional Assistance: While we owe no fiduciary duty to either party, we greatly desire that their interests are served. As such, we will make suggestions that the parties obtain expert advice from outside professionals -- ones who are free to enter into a fiduciary relationship with the client and in a position to put the client's financial interests first.

Accountancy: We will properly and factually account for all money and property received. This role of accountancy guarantees that funds are handled properly in a responsible manner, untainted by potential outside interests.

Communication: We will facilitate the exchange of information between the parties. By taking on the role of facilitator, we will strive to make sure all relevant information is disseminated to all interested parties quickly and accurately.

Full Disclosure: We will disclose all known material defects about a property. We owe this duty to both buyers and sellers. Buyers want to know the status and condition of a property they are making a financial commitment to purchase, and sellers are subject to mandatory disclosure laws that we are committed to adhering to so that they comply with legal and ethical requirements of disclosure.

Transactional Administration: We will assist the parties in completing the transaction. Whether it's coordinating the roles of all attorneys involved in the negotiations and process, or preparing the contracts and settlement statements, we are beholden to facilitating the transaction in an efficient, seamless manner.

Honesty & Integrity: We will uphold our duty as an impartial facilitator for the transaction with the utmost honesty and in an ethical manner - one that serves to facilitate the transaction for both buyers and sellers without bias or agendas.
